1. General Disclaimer
This site is operated in partnership with Memorial Shops, a third-party fulfillment and logistics provider. While our funeral home offers customer support and oversees memorial product selection, all physical order processing, fulfillment, and shipping are handled by Memorial Shops.
2. Order Accuracy & Customer Responsibility
- Customers are fully responsible for the accuracy of the information provided at checkout, including names, dates, shipping addresses, and customization text.
- Before submitting your order, you will be required to acknowledge that you have reviewed all details thoroughly and approve the content as final.
3. Customization & Engraving
- By submitting an order with personalization, you confirm that all text and details have been reviewed and are accurate. Once production begins, changes cannot be made under any circumstance.
- Our personalization team reserves the right to make edits to your personalization proof for formatting / fitting / other reasons.
- We strive to ensure faithful rendering; however, minor differences may occur due to font compatibility, formatting, and digital conversion (e.g., to curves).
- We are not liable for engraving errors if the submitted form was approved or submitted without objection.
- Customized products may not be returned or exchanged.
4. Shipping & Delivery
- All products ship from our central fulfillment center in San Francisco, CA, unless otherwise specified.
- Estimated delivery times are provided via FedEx API and are non-binding estimates only.
- We cannot guarantee delivery times or dates, including but not limited to FedEx delays, weather disruptions, or customs issues.
- Orders are considered fulfilled once handed to the shipping carrier. Responsibility for delivery passes to the customer upon shipment.
By placing an order, you agree to the following:
- You have reviewed and accepted the estimated shipping timeline.
- You acknowledge that delivery guarantees are limited to FedEx’s 2nd Day AM service or lower.
- You will not hold our funeral home or Memorial Shops responsible for delays caused by third-party carriers.
5. Returns & Cancellations
- Due to the custom and sensitive nature of memorial products, returns and cancellations are not accepted once production has started.
- All return or refund requests for damaged items must be accompanied by:
- Photographic Evidence – Customers are required to provide clear photos of the damaged product and its packaging.
- Proof of Shipment – Customers must supply the shipment tracking number associated with the order.
- These materials are necessary for us to file a claim with the carrier and process a replacement or refund. Requests submitted without photos and the tracking number cannot be approved.
- Upon receipt of the required documentation, our claims representatives will review the submission. Once approved, a replacement will be shipped or a refund processed in accordance with our policy.
Chargebacks
By placing an order with us, you agree to follow our published Returns and Cancellations Policy as the sole method for resolving any product or service concerns.
Initiating a chargeback with your financial institution without first contacting us and allowing us to resolve the issue may be considered a breach of this agreement. In cases where a chargeback is filed outside of our stated policy, we reserve the right to:
- Dispute the chargeback with all supporting documentation, including proof of shipment, delivery, and communications;
- Recover any chargeback fees or associated costs by invoicing the customer directly or deducting them from any future refunds; and
- Refuse future service or sales to customers who engage in improper chargeback activity.
6. Limitation of Liability
To the fullest extent permitted by law:
- This funeral home or Memorial Shops shall not be held liable for any damages, emotional distress, or losses resulting from delays, misprints, incorrect orders caused by user error, or third-party shipping failures.
- Our liability is strictly limited to the value of the product purchased.
7. Terms Changes
We reserve the right to update these Terms and Conditions at any time. Any changes will be posted on this page and will take effect immediately.
